Please read these terms and conditions carefully before ordering any items from our site. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference.
 

1. INFORMATION ABOUT US

1.1 www.sugarhillboutique.com is a site operated by Sugarhill Boutique Limited (we). We are registered in England and Wales under company number 6557759 and with our registered office at 19 New Road, Brighton, BN1 1UF . Our VAT number is 881749577.

2. YOUR STATUS

By placing an order through our site, you warrant that:
(a) You are legally capable of entering into binding contracts; 
(b) You are at least 18 years old

Access to and use of this Web site and the products and search services available through this Web site (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of these terms, conditions and notices, without modification. Furthermore, you acknowledge that the Terms of Service’ may be updated by us from time to time.

3. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

3.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been despatched (the Despatch Confirmation). The contract between us (Contract) will only be formed when we send you the Despatch Confirmation.

3.2 The Contract will relate only to those Products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

3.3 Any drawings, descriptions or advertising we issue, and any descriptions or illustrations contained on our website are published solely to provide you with an approximate idea of the products they describe. They do not form part of the contract between you and us or any other contract between you and us for the sale of the products.

3.4 We reserve the right to make any changes in the specification of the products which are required to conform with any applicable statutory or EC requirements or, which do not materially affect their quality or performance.

5. AVAILABILITY AND DELIVERY

5.1 Your order will be fulfilled within 7 days of despatch or, if international then within a reasonable time of the date of the Dispatch Confirmation, unless there are exceptional circumstances. Next Day delivery will be fulfilled by 1pm the next working day if ordered by 12pm Monday - Thursday.

5.2 If the products you order become unavailable or are out of stock, we will inform you of this as soon as reasonably possible and advise you of your right to a refund.

5.3 If you fail to take delivery of the Products and they are returned to us, you may be re-charged the appropriate delivery charge.

5.4 Where we offer and you accept free UK delivery, then delivery will be by Royal Mail 1st class post.  If you choose to accept free delivery, you accept that

(A)            delivery is by Royal Mail 1st class post only;

(B)            proof of postage will be deemed proof of delivery; and

(C)            We will not be liable for any non-delivery or for goods lost or damaged in transit as long as we are able to show proof of posting to the delivery address provided by You.

5.5 FOR THE PURPOSES OF CLAUSE 5.4, A ROYAL MAIL CERTIFICATE OF POSTING SHOWING THE CORRECT DELIVERY ADDRESS AS SUPPLIED BY YOU WILL BE DEEMED AS PROOF OF POSTING

6. RISK AND TITLE

6.1 The Products will be at your risk from the time of delivery.

6.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges and we have accepted your order.

7. PRICE AND PAYMENT

7.1 The price of any Products will be as quoted on our site from time to time, except in cases of obvious error.

7.2 These prices include VAT but exclude delivery costs, which will be added to the total amount due.

7.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

7.4 Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when despatching the Product to you (refunding the difference via your original form of payment). If a product's correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before despatching the product, or reject your order and notify you of such rejection.

7.5 We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

GENERAL NOTICES

 COLOUR REPRODUCTION

We take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate however specifications may change.

GARMENT VARIATION

A number of Sugarhill Boutique Items are individually handcrafted, using various techniques such as batik and tie-dye. Colour, design and embroidery variations are inherent in the handmade process. Any irregularities add to the creative uniqueness of this garment.  Wear with pride, your piece is unique!

DISCOUNT CODES & PROMOTIONS

These cannot be used in conjunction with other voucher codes or promotions and will not work on already discounted stock.
We reserve the right to withdraw any promotional discounts and to refund any orders that involve the use of invalid or incorrect voucher/discount codes. Promotional free goods such as bags are subject to stock limitations. Should the item advertised be unavailable we will endeavour to provide a similar item - for example a bag with a different print - stock willing. This does not affect your statutory rights as a consumer.
 

PROHIBITIONS

You will not commit or encourage a criminal offence; transmit or distribute a virus, Trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through the minauk.com Web site. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Sugarhill Boutique will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

The Site and it’s content are protected by intellectual property rights, including copyright and trademarks, as detailed in our Copyright and Trade Mark Notice. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise. Except as expressly authorised by us or relevant third parties, you agree not to copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Site, in whole or in part.
